1. Agreement

These Terms of Service (the "Terms") govern your access to and use of bitcoinpopindex.com, its subdomains, its content, data, charts, reports, application programming interfaces and any related services (together, the "Site"). The Site is operated by Open Source FZ-LLC ("Open Source", "we", "us", "our"), a free-zone limited liability company registered in Dubai, United Arab Emirates, which also operates the publication The Bitcoin Digest.

By accessing or using the Site you agree to be bound by these Terms and by our Privacy Policy, which forms part of them. If you do not agree, do not use the Site. If you use the Site on behalf of an organisation, you confirm that you have authority to bind it, and "you" includes that organisation.

2. What the Site is

The Site publishes the Bitcoin Popularity Index (the "Index"): a research index measuring public search interest in Bitcoin by country, region and city, derived from aggregate search-volume statistics obtained from third-party tools and from public data sources. The Index and everything published with it — rankings, scores, tiers, grades, shares, charts, maps, reports, commentary and methodology (together, the "Content") — is editorial and informational material.

3. No advice; no measure of ownership

3.1 Nothing on the Site constitutes financial, investment, trading, tax, accounting or legal advice, or an offer, solicitation or recommendation to buy, sell, hold or otherwise deal in Bitcoin, any cryptocurrency, security, commodity or other asset.

3.2 The Index measures search interest. It does not measure, estimate or imply ownership, adoption, holdings, trading activity, price, value or the merits of any asset, and it must not be read as doing so. A high position means people are searching, nothing more.

3.3 You are solely responsible for any decision you make in reliance on the Site. Bitcoin and other digital assets are volatile and can lose all their value.

4. Accuracy and changes to the Content

4.1 We build the Index with care and publish our methods openly. The underlying search-volume statistics are supplied by third parties, are estimated, bucketed and periodically revised by those parties, and are subject to the limitations described on our Method page. Figures may be corrected between editions.

4.2 The Site and the Content are provided "as is" and "as available". To the fullest extent permitted by law we make no representation or warranty of any kind, express or implied, as to their accuracy, completeness, timeliness, reliability, merchantability, fitness for a particular purpose or non-infringement.

4.3 We may add to, change, correct, suspend or withdraw any part of the Site or Content at any time without notice.

5. Licence to use the free Content

5.1 Permitted use. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to view the free Content for personal, educational, journalistic or internal business use, and to quote, cite and share it provided that you:

(a) attribute it to "Bitcoin Popularity Index" with a link to bitcoinpopindex.com; (b) do not alter figures, charts or maps or present them out of context; (c) reproduce charts and maps only unaltered and with their attribution intact; and (d) do not imply our endorsement of you or your product.

5.2 Prohibited use. Except as expressly permitted in writing by us, you must not:

(a) scrape, crawl, spider, harvest, mirror or bulk-download the Site or any Content, whether manually or by automated means; (b) extract, reproduce, republish or redistribute the underlying dataset, any table of figures, or any substantial part of the Content, in any medium, including as a feed, database, spreadsheet or file; (c) use the Content, in whole or in part, to train, fine-tune, evaluate or ground any machine-learning or artificial-intelligence model, or as an input to any automated content-generation system; (d) remove, obscure or alter any attribution, notice or watermark; (e) sell, license, rent or otherwise commercialise the Content or access to it; (f) present the Index, its figures or its methodology as your own, or create a derivative index from it; (g) frame the Site or hot-link its charts and maps without permission; (h) interfere with the operation or security of the Site, probe or test its vulnerabilities, or circumvent any access control or paywall, including any Lightning-payment unlock; (i) use the Site in breach of any law, or to infringe anyone's rights.

5.3 Press. Journalists may reproduce Content, including charts and maps, in editorial coverage with attribution. Please use the press kit where one is provided.

6. Paid, unlocked and licensed data

6.1 Some Content is available only on payment (for example content unlocked with a Lightning payment), under a subscription plan, through an API key, or under a written data licence (together, "Paid Content").

6.2 Paid Content is licensed, not sold. Unless a written licence says otherwise, Paid Content is for the purchaser's own internal use only; it may not be redistributed, resold, published, shared with third parties or used for any of the purposes in Section 5.2. Plan-specific terms, usage limits and permitted uses stated at the point of purchase or in the licence apply in addition to these Terms and prevail over them in case of conflict.

6.3 API keys are personal to the account to which they are issued, must be kept confidential, and may be revoked for breach.

6.4 We may verify that Paid Content is being used within its licence and may suspend or terminate access on reasonable suspicion of breach.

7. Payments

7.1 Where the Site accepts payment in bitcoin, including over the Lightning Network, payments are processed by a third-party provider and are irreversible by nature. Once content has been unlocked or delivered, the payment is final, except where the law of your country of residence gives you a non-waivable right of withdrawal or refund, in which case we will honour it.

7.2 Prices are shown in satoshis or bitcoin, or in a fiat currency where stated, and may change at any time. You are responsible for any network fees, taxes or duties arising from your payment.

7.3 We do not hold customer funds and do not provide wallet, custody, exchange or money-transmission services.

7.4 Donations are voluntary, non-refundable and confer no rights.

8. Accounts, email and communications

8.1 Where you provide an email address, you consent to receive the communication you requested and to our use of the address as described in the Privacy Policy. Every marketing email contains an unsubscribe link.

8.2 You are responsible for keeping any credentials, API keys or unlock tokens confidential and for all activity under them.

9. Corrections and contributions

9.1 We welcome corrections. If you believe a figure is wrong, write to hello@bitcoinpopindex.com with the evidence. We may credit corrections publicly and, at our discretion, reward them; any reward is a gratuity, not a contract.

9.2 By submitting a correction, comment or other material to us, you grant us a worldwide, perpetual, royalty-free licence to use it in connection with the Site and our publications, and you confirm you have the right to do so. We are not obliged to use it.

10. Intellectual property

10.1 The Index, the Content, the Site's design, text, code, charts, maps, compilations of data, the selection and arrangement of data, and the methodology descriptions are owned by Open Source FZ-LLC or licensed to it, and are protected by copyright, database rights and other intellectual-property laws worldwide. All rights not expressly granted are reserved.

10.2 "Bitcoin Popularity Index", "BPI" as used for the Index, and "The Bitcoin Digest" are names and marks of Open Source FZ-LLC. You may use them only to refer to the Index and its publications accurately, and not in any way that suggests affiliation or endorsement.

10.3 The underlying search-volume statistics are supplied by Google and other providers under their own terms and remain their property. Third-party marks appearing on the Site (including names of companies, exchanges and products) belong to their owners and are used for identification only.

11. Third-party services and links

The Site links to and relies on third-party websites and services, including data providers, hosting, email delivery, payment processors, exchanges and publications. We do not control them, are not responsible for their content, availability, security or practices, and a link is not an endorsement. Your dealings with them are subject to their terms.

12. Availability; suspension; termination

12.1 We do not guarantee that the Site will be available, uninterrupted or error-free. We may modify, suspend or discontinue the Site or any part of it at any time.

12.2 We may restrict, suspend or terminate your access, including any Paid Content or API key, immediately and without notice if we reasonably believe you have breached these Terms, and may take legal action where appropriate.

12.3 Sections 3, 4, 5.2, 6, 10, 13, 14 and 15 survive termination.

13. Disclaimer and limitation of liability

13.1 To the fullest extent permitted by law, Open Source FZ-LLC, its officers, employees, contractors and licensors exclude all liability for any loss or damage of any kind, whether direct, indirect, incidental, special, consequential or punitive, including loss of profit, revenue, data, goodwill or investment value, arising out of or in connection with the Site, the Content, any Paid Content, or your use of or reliance on any of them, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if advised of the possibility of such loss.

13.2 If liability cannot be excluded by law, our total aggregate liability to you for all claims in any twelve-month period is limited to the greater of (a) the amount you paid us for Paid Content in that period and (b) one hundred United States dollars (USD 100).

13.3 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded or limited.

14. Indemnity

You agree to indemnify and hold harmless Open Source FZ-LLC and its officers, employees and contractors against all claims, losses, liabilities, costs and expenses (including reasonable legal fees) arising from your breach of these Terms or your unlawful use of the Site or Content.

15. Governing law and disputes

15.1 These Terms and any dispute arising out of them or the Site are governed by the laws of the Emirate of Dubai and, where applicable, the federal laws of the United Arab Emirates.

15.2 The courts of Dubai, United Arab Emirates, have exclusive jurisdiction, save that (a) we may seek injunctive relief in any competent court to protect our intellectual property, and (b) if you are a consumer resident in a jurisdiction whose law gives you the non-waivable right to bring proceedings in your local courts or to the protection of your local consumer law, nothing in this Section deprives you of that right.

15.3 Before starting proceedings, each party agrees to attempt in good faith to resolve any dispute by correspondence with the other for at least 30 days.

16. General

16.1 Entire agreement. These Terms, the Privacy Policy and any plan or licence terms are the entire agreement between you and us about the Site. 16.2 Severability. If any provision is held invalid, the rest continues in force. 16.3 No waiver. Our failure to enforce a provision is not a waiver of it. 16.4 Assignment. You may not assign these Terms. We may assign them to a successor to the Site or our business. 16.5 Force majeure. We are not liable for any failure caused by events beyond our reasonable control. 16.6 Changes. We may update these Terms. The current version, with its effective date, is always at bitcoinpopindex.com/terms. For material changes we will give reasonable notice on the Site or by email to subscribers. Continued use after the effective date is acceptance. 16.7 Language. These Terms are written in English; any translation is for convenience only.
